浦东新区法规在行政复议中的适用优先性研究

摘　　要：作为全国人大常委会特别授权创设的一种特殊的地方性法规,浦东新区法规法规的法律地位独具双重特性,既体现了特殊授权立法的独有风貌,又兼具了地方性法规的特殊属性。这一独特性使得其法律位阶的判定及在新行政复议法中的运用引发了众多争议。浦东新区法规的法律位阶与适用优先性,构成了两个紧密联系、相互依赖的法律议题。通过对《立法法》及《授权决定》的深度解读,浦东新区法规在法律位阶上与国家法律并肩,享有特定的优先适用权利;同时,考虑到立法权限,仍需坚守法律的绝对保留原则。在此框架下,浦东新区法规的优先性与灵活性得以凸显,以满足其改革开放和现代化建设的特定需求。The Pudong New Area Regulations,as a new type of local legislation created by the Standing Committee of the National People's Congress through a delegation of authority decision,have a dual legal status,i.e.,they simultaneously embody the characteristics of special delegated legislation and special local legislation.Therefore,the definition of its legal status has sparked extensive discussions and controversies in the academic and practical communities.The legal status and application priority of the Pudong New Area Regulations are two closely related and interdependent legal issues.Only by clearly defining the legal status of the regulations can we give a clear response to whether they have application priority.By conducting a thorough analysis of relevant provisions of the Legislation Law and the Delegation of Authority Decision,we can draw the following conclusion:in terms of legal status,the Pudong New Area Regulations are on par with laws and enjoy unique priority of application.However,from the perspective of legislative authority,strict adherence to the absolute reservation principle of law is still required.Based on this,the reviewing authority in Pudong New Area should focus its review on whether the administrative act falls within the scope of regulation of the Pudong New Area Regulations.However,it is worth noting that how to ensure the legitimacy of the Pudong New Area Regulations and how to take effective measures for administrative review in case of legal defects are still important issues that need to be solved urgently.
