意定监护中监护人责任的解释论研究

摘　　要：意定监护人在履行职责时所面临的法律责任界定不清、认定标准模糊以及赔偿过程中的不公平与延迟救济等问题构成了现行制度的主要挑战。最合理的裁判路径应是“判决被监护人赔偿且监护人对不足部分补充赔偿”,这与司法解释中的规定相吻合,能够更好地保护被侵权人的权益,同时也符合法律规定的责任承担顺序。The unclear definition of legal responsibilities,vague standards for determination,and issues of unfairness and delayed relief in the compensation process faced by designated guardians constitute the main challenges of the current system.The most reasonable judicial approach should be"ordering the ward to compensate and the guardian to compensate for any shortfall,"which aligns with the provisions of the judicial interpretation and better protects the rights and interests of the infringed party,while also conforming to the order of responsibility assumed as stipulated by law.
