检察视角下惩治新型毒品犯罪的发展进路

摘　　要：近年来,新型毒品犯罪案发数量持续增长且分布地域广泛,具有生产方式相对简单、交易方式越发隐蔽、运输方式更加多样等特征。从检察办案环节来看,目前还存在列管规定相对滞后、量刑设置不尽合理、协作打击配合乏力、证据收集审查难、宣传教育力度不足等问题亟待解决。为更好地惩治此类犯罪,需要充分发挥司法和行政机关的作用,从加强和改进对新型毒品的列管工作、构建新型毒品犯罪的二元量刑体系、推动形成惩治新型毒品犯罪的合力等方面进行改进,从制度、个体和社会等层面采取措施。In recent years,the number of new drug crimes has continued to grow and are widely distributed,characterized by relatively simple production methods,increasingly covert trading methods,and more diverse transportation methods.From the perspective of the prosecution and case handling process,there are still problems that need to be addressed urgently,such as relatively lagging management regulations,unreasonable sentencing settings,increased cooperation in cracking down,difficulty in collecting and reviewing evidence,and insufficient publicity and education efforts.In order to better punish such crimes,it is necessary to fully play the role of judicial and administrative organs,and improve the management of new drugs,construct a binary sentencing system for new drug crimes,and promote the formation of a joint force to punish new drug crimes.Measures should be taken from the institutional,individual,and social levels.
