摘　　要：电商平台上存在个别商户未经著作权人许可,擅自售卖含有大量盗版音乐作品的U盘、光盘、网盘等,涉嫌侵犯著作权犯罪。该类互联网侵犯音乐著作权犯罪以往并非侵犯著作权刑事犯罪的打击重点,司法实践应予以重视,并对其特点、构成要件及审查要点予以明确。There are individual merchants on e-commerce platforms who sell USB drives,CDs,online drives,etc.containing a large number of pirated music works without the permission of the copyright owner,suspected of copyright infringement crimes.This kind of internet crime of music copyright infringement was not the focus of criminal crime of copyright infringement in the past,so judicial practice should pay attention to it,and clarify its characteristics,constituent elements and review points.
