摘　　要：轻罪时代,犯罪结构发生变化,监狱短刑犯数量剧增,短刑犯的改造成效对社会安全与法治建设至关重要。调研剖析当前短刑犯改造激励机制现状后,发现监狱短刑犯改造激励中存在激励机制的战略性考虑不足,过于依赖计分考核,未能根据短刑犯的特点和改造需求制定差异化的激励政策;激励手段难以调动短刑犯改造积极性,导致激励措施的实效性不足等问题。基于此,对短刑犯改造激励体系进行再设计,指出“去标签化”改造理念应当作为改造激励工作的思想前提,改造过程建立以需求为导向的激励措施,构建并依托附条件轻微犯罪记录封存制度维护改造成果并激励短刑犯积极再社会化。在改造和回归的全过程中,全面激活短刑犯改造动力,提升改造质量,促进其再社会化,降低重新犯罪率,从而为社会安全与法治建设贡献力量。In the era of misdemeanors,the structure of crime has changed,and the number of short-sentence prisoners in prison hasincreased sharply.After investigation and analysis of the current situation of the incentive mechanism for the reform of short sentence prisoners,it is found that there are insufficient strategic considerations in the incentive mechanism,too dependent on the score assessment,and failed to formulate differentiated incentive policies according to the characteristics of short sentence prisoners and the reform needs.It is difficult for incentive means to mobilize the enthusiasm of short-sentence prisoners to reform,which leads to the insufficient effectiveness of incentive measures.Based on this,the reform incentive system of short-sentence offenders is redesigned,and the concept of"de-labeling"should be taken as the ideological premise of the reform incentive work.In the reform process,demand-oriented incentive measures should be established,and the conditional minor crime record sealing system should be constructed and relied on to maintain the reform results and encourage the short-sentence offenders to actively re-socialization.In the whole process of reform and return,comprehensively activate the motivation of short-sentence prisoners to reform,improve the quality of reform,promote their re-socialization,and reduce the re-crime rate,so as to contribute to social security and the construction of the rule of law.
