摘　　要：《中华人民共和国农村集体经济组织法》规定了农村集体经济组织成员资格认定的一般标准与特殊情形。其成员资格认定的一般标准为,当事人同时满足户籍、权利义务关系、基本生活保障等全部要素。其成员资格认定的特殊情形包括新增取得、申请取得、依法保留三类。农村集体经济组织章程可为因结婚、收养或者政策性移民而新增取得方式和申请取得方式增设成员大会表决或费用交纳等要件;对于成员资格依法保留的七种情形,农村集体经济组织必须无条件认定其成员资格,不得增设其他要件。农村集体经济组织成员大会应依法作出成员身份确认的决定,内容违法的决定无效;内容违反章程的决定可撤销。成员大会存在严重程序瑕疵的,其决定不成立;成员大会仅存在轻微程序瑕疵的,其决定可撤销。Rural Collective Economic Organizations Law of China stipulates the general standard and special circumstances for the determination of the membership of rural collective economic organizations.The general standard for the membership is that the party satisfies all the elements involving household registration,relationship of rights and obligations,and secured basic standard of living at the same time.The special circumstances for the membership include those for newly-gained membership,application for membership and retention in accordance with laws.The bylaw of the rural collective economic organization may add requirements such as voting in the members'meeting or payment of fees for newly-gained membership and application for membership due to marriage,adoption or policy-based immigration.However,for the seven circumstances in which membership is retained in accordance with laws,rural collective economic organizations shall unconditionally recognize the membership,and shall not add any other requirements.The members'meeting of the rural collective economic organization shall make a decision on the membership in accordance with laws,and a decision violating laws in terms of content shall be invalid;a decision violating bylaws in terms of content may be revoked.If there are serious procedural defects in the members'meeting,the decision shall not be established;if there are only minor procedural defects in the members'meeting,the decision may be revoked.
