摘　　要：做好《中华人民共和国农村集体经济组织法》的解释适用首先需要厘清其价值原则体系及其内在逻辑。《中华人民共和国农村集体经济组织法》贯彻了成员平等、团体自治、分权制衡、适当干预、成员权保障等多元价值原则,形成了层次清晰、逻辑严密的价值原则体系。其中,成员平等是基础、团体自治是核心、分权制衡是工具、适当干预是手段、成员权保障是根本。《中华人民共和国农村集体经济组织法》坚持权利本位,将成员权保障原则作为制度设计和规范表达的价值原则之一,旨在满足农村集体经济组织成员的利益需求并形成农村集体经济组织法人的治理秩序。《中华人民共和国农村集体经济组织法》的制度和规范在成员权保障原则的指引下,围绕成员身份和收益权量化、成员权体系与赋能、成员权行使与实现、成员权保障与救济等方面构建了农村集体经济组织成员权的综合治理体系。To effectively interpret and apply Rural Collective Economic Organizations Law of China,it is necessary to first clarify the system of its values-based principles and their internal logic.The Rural Collective Economic Organizations Law of China implements diverse values-based principles such as equality of members,group autonomy,checks and balances,appropriate intervention,and protection of Members'Rights,thus forming a clear and logically rigorous system of values-based principles.Among them,equality of members is the basis,group autonomy is the core,checks and balances are tools,appropriate intervention is the means,and protection of members'rights is foundation.The Rural Collective Economic Organizations Law of China adheres to the right-based approach and regards the principle of protecting members'rights as one of the values-based principles for institutional design and norm-oriented expression,with the aim to meet the interest-based needs of members of rural collective economic organizations and form a governance order for rural collective economic organizations as legal persons.The system and norms of the Rural Collective Economic Organizations Law of China,guided by the principle of protecting members'rights,have established a comprehensive governance system for the members'rights of rural collective economic organizations,focusing on the quantification of membership and income rights,the system of members'rights and empowerment,exercise and realization of members'rights,and protection and relief of members'rights,etc.
