摘　　要：党的二十届三中全会提出“探索建立个人破产制度”,这是完善市场经济基础制度、推动构建高水平社会主义市场经济体制的重大改革举措。党的十八大以来,根据党中央决策部署精神,最高人民法院把“研究推动建立个人破产制度及相关配套机制”作为司法改革重要任务,部署开展个人破产审判试点工作。浙江、江苏两省法院在现行法律框架内开展与个人破产制度功能相当的个人债务集中清理试点工作,深圳法院依据经济特区个人破产条例开展个人破产审判试点工作。试点先行探索了“个人可破产、可重整,更可再创业”的有效路径,其做法、经验及释放的效应为探索建立个人破产制度提供了必要性、可行性、紧迫性的实践基础。新的起点上,要坚持在法治下推进改革和在改革中完善法治相统一,进一步深化试点工作,推动完善破产法律制度、建立个人破产法律制度,筑牢高水平社会主义市场经济体制的基石。The Third Plenary Session of the 20th Central Committee of the Communist Party of China proposed"exploring the establishment of an individual bankruptcy system",which is a major reform measure to improve the basic systems of the market economy and promote the construction of a high-level socialist market economic system.Since the 18th National Congress of the Communist Party of China,in accordance with the spirit of the decision-making and deployment of the Central Committee,the Supreme People's Court has taken"studying and promoting the establishment of an individual bankruptcy system and related supporting mechanisms"as an important task of judicial reform,and arranged and carried out pilot work on individual bankruptcy trials.The courts in Zhejiang and Jiangsu provinces have carried out pilot work on centralized liquidation of personal debts,which is equivalent to the functions of the individual bankruptcy system,within the framework of current laws.The Shenzhen courts have carried out pilot work on individual bankruptcy trials in accordance with the regulations on individual bankruptcy in special economic zones.The pilot work has explored an effective path of"individuals can go bankrupt,restructure,and even start businesses again".Its practices,experiences,and the effects released have provided a practical basis for the necessity,feasibility,and urgency of exploring the establishment of an individual bankruptcy system.At this new starting point,we should adhere to the unity of promoting reform under the rule of law and improving the rule of law in the process of reform,further deepen the pilot work,promote the improvement of the bankruptcy legal system,establish an individual bankruptcy legal system,and lay a solid foundation for a high-level socialist market economic system.
