摘 要:随着《民法典》的出台,以及统一不动产登记体系、动产抵押、权利质权等动产和权利登记体系的建立,我国财产权的登记体系已趋于完备,其所构建的权利公示体系,对于保护财产交易安全发挥了重要作用。但是,不同财产权的登记能力和登记审查标准不同,导致登记的公示效力存在较大差异。只有厘清不同财产权的登记能力和登记审查标准,并在此基础上正确判定不同登记的公示效力,才能充分发挥财产权登记体系对依法行政的助力作用。本文从对各种财产权登记能力和登记审查标准的考察出发,提出审查强度与登记公示效力相挂钩的登记审查标准,明确了不同财产权登记在公示效力上的差异,并在此基础上就公示效力对行政行为的影响进行了分析。With the promulgation of the Civil Code and the establishment of a unified registration system for immovable property,movable property mortgages,and rights pledges,China's property rights registration system has become increasingly complete.The constructed rights publicity system plays a critical role in safeguarding the security of property transactions.However,differences in the registrability and registration review standards of various property rights have resulted in significant variations in the publicity effect of registrations.Only by clarifying the registrability and registration review standards for different property rights and accurately determining the publicity effects of various registrations on this basis can the property rights registration system fully support law-based administration.This paper examines the registrability and registration review standards of various property rights,proposes a registration review standard linking review intensity with publicity effects,clarifies the differences in publicity effects among different property rights registrations,and analyzes the impact of publicity effects on administrative actions.
