摘　　要：2024年12月,第79届联合国大会正式通过《联合国打击网络犯罪公约》,成为联合国主持制定的首个网络治理全球性公约。现结合公约谈判案文及各方立场主张等,全面辨析“网络犯罪”“利用信息通信技术系统实施的犯罪”“公约确立的刑事犯罪”等重要概念,深入评析公约的定罪范围、程序措施、国际合作机制、主权原则与人权保护、预防和技术援助、议定书的谈判等核心问题,为全面理解公约宗旨和主要内容提供第一手资料,为正确解释适用公约有关规则、深入研究公约同我国国内法的关系等提供重要参考。In December 2024,the 79th Session of the United Nations General Assembly adopted the United Nations Convention against Cybercrime;strengthening international cooperation for combating certain crimes committed by means of information and communications technology systems and for the searing of Evidence in electronic form of serious crimes(hereinafter referred to as the UN Convention against Cybercrime).This marks the first global convention on internet governance developed under the auspices of the United Nations.On the basis of the negotiation history of the Convention as well as the positions of various Member States,this article comprehensively analyzes the key concepts such as"cybercrime","crimes committed by means of information and communications technology systems",and"criminal offences established in accordance with this Convention".It provides an in-depth assessment of core issues including the scope of criminalization,procedural measures,international cooperation mechanisms,the principle of sovereignty and human rights protection,prevention and technical assistance,and the negotiation of protocol.This article facilitates the comprehensive understanding on the purpose and main content of the Convention's through those insider’s information and material.It also serves as an important reference for the interpretation and application of the Convention's rules,as well as for in-depth research on the relationship between the Convention and domestic laws of China.
