摘　　要：“《纽约时报》诉OpenAI”一案凸显了生成式人工智能技术在新闻作品应用中所引发的版权争议。这一争议的核心在于,生成式人工智能服务是一种新型媒介,新闻作品不仅具有传统版权作品的属性,还兼具数据资产的特性。单纯的合理使用制度已经难以解决技术公司与版权人之间的紧张关系。为此,首先,完善“选择进入”机制,通过建立强制协商制度,确保版权人在新闻作品被用于AIGC训练前享有决定权,并落实披露义务,增强透明度与可解释性。其次,在“进入之后”采取保障措施,一方面,要求AIGC生成内容必须注明新闻作品出处,并通过自动标注与分阶段审核确保准确性;另一方面,确立合理的公平获酬机制,综合考虑作品价值、利用程度及商业收益,确保版权人获得公平报酬。这些措施均旨在平衡版权保护与技术创新,促进新闻作品在AIGC时代的健康利用。“The New York Times v.OpenAI”case highlights the copyright controversy arising from the application of generative artificial intelligence technologies to journalistic works.At the heart of this controversy is the fact that generative AI services are a new type of medium,and journalistic works not only have the attributes of traditional copyrighted works,but also the characteristics of data assets.A simple fair use system has been difficult to resolve the tension between technology companies and copyright holders.Therefore,this paper proposes the following countermeasures.Firstly,improve the“opt-in”mechanism,through the establishment of a mandatory consultation system,to ensure that copyright holders have the right to decide on the use of journalistic works for AIGC training,and implement the disclosure obligation to enhance transparency and interpretability.Secondly,safeguard measures should be taken after“access”.On the one hand,AIGC-generated content should be required to indicate the source of journalistic works,and ensure accuracy through automatic labeling and phased auditing.On the other hand,a reasonable and fair remuneration mechanism should be established,taking into account the value of the works,the degree of utilization and commercial returns,to ensure that copyright holders are fairly compensated.All these measures aim at balancing copyright protection and technological innovation,and promoting the healthy utilization of news works in the AIGC era.
