摘 要:经济制裁的大量实施不仅破坏了商事交易的自发性和稳定性,也对国际商事仲裁制度的高效运转形成挑战。以最小化经济制裁对商事仲裁的冲击为功能目标,我国应遵循制裁影响仲裁的逆序传导逻辑设计冲突调和规则。在承认及执行阶段,法院应避免将特定外交形势下为维护政治利益而制定的制裁规则认定为公共政策。以此为预期,仲裁庭在受理涉制裁纠纷时应践行支持仲裁的立场,而在处理实体争议时应尽量在当事人合理预期的范围内选用准据法。功能主义视角下的规则构建不仅可以最大化全球福利,也能在维持意思自治与公法干预动态平衡的过程中促成我国商事仲裁的持续繁荣。Constant economic sanctions not only undermine the spontaneity and stability of commercial transactions but also challenge the efficiency of the international commercial arbitration system.Aiming to minimize their impact on commercial arbitration,China should formulate rules for conflict resolution that follow the inverse transmission logic of how sanctions affect arbitration.During the recognition and enforcement phases,courts should avoid treating sanction rules established under specific diplomatic circumstances for the protection of political interests as part of public policy.Accordingly,arbitration tribunals should adopt a pro-arbitration stance when handling disputes involving sanctions,and select applicable laws within the reasonable expectations of the parties when addressing substantive disputes.The rule-building from a functionalist perspective can not only maximize global welfare but also promote the sustainable prosperity of China’s commercial arbitration while maintaining a dynamic balance between party autonomy and public law intervention.
