开放农林牧渔业发展中的涉外风险及其法治应对——基于“负面清单”的分析视角

摘　　要：农林牧渔业在中国深化改革开放过程中会面临各种涉外风险。负面清单是中国观察这些涉外风险的重要视角,它代表国家对农林牧渔业开放态度中的例外,但这种限制或禁止不足以应对所有类型的风险,负面清单外完全开放领域面临的风险还涵盖多种类型,具体包括各领域泄露秘密或情报的风险、经济领域开放或管理部署不当导致的风险、涉农林牧渔业的研发伦理风险以及农林牧渔业开放过程中可能面对的生态安全风险。据此,要在强化防控能力的同时,融入整体性治理的法治思维,在政治、经济、科技和生态等法治方面强化应对举措,构建相对统一的涉外风险法治应对体系。Agriculture,forestry,animal husbandry,and fishery industries will face various foreign related-risks in the pro-cess of deepening reform and opening up.The negative list is an important perspective for China to observe these foreign-re-lated risks,representing exceptions in the country's open attitude towards agriculture,forestry,animal husbandry,and fishery industries.However,the limitation or prohibition can't deal with all types of risks.In addition to the foreign-related risks in the development of agriculture,forestry,animal husbandry,and fishery industries on the negative list,the types of risks faced by fully open areas outside the negative list in China also have various specific types,including the risks of leaking secrets or intelligence in various fields,risks caused by opening up or improper management deployment in the economic field,ethi-cal risks in research and development related to agriculture,forestry,animal husbandry,and fishery industries,and ecological security risks that may be faced during the process of opening up agriculture,forestry,animal husbandry,and fishery indus-tries.Based on this,while strengthening prevention and control capabilities,we can integrate the rule of law thinking of holis-tic governance,strengthen response measures in politics,economy,technology,and ecology,and build a relatively unified le-gal response system for foreign-related risks.
