法典化视角下生态环境行政权力内部监督机制研究

摘　　要：根据功能性分权理论,权力内部监督是实现权力效能的重要方面。生态环境行政权力内部监督机制是生态文明建设中国家公权力运行的重要组成部分。这一制度机制当前主要由党内法规制度体系提供规范依据,缺乏统一、明确的法律规定。在法治层面的不足体现在制度设计有待完善、机制体系有待构建、规范依据有待补充。生态环境行政权力内部监督的立法完善和机制构建应当通过法典化的方式实现。在立法技术层面,以落实《宪法》规定的国家环保义务为目标,通过功能性分权理论的指引,将生态环境行政权力内部监督机制作为生态环境法典中落实地方政府生态环境保护责任的保障制度,并且在总则编中统一建构具体规则。According to the theory of functional separation of powers,internal supervision of power is an important aspect of achieving the effectiveness of power.The internal supervision mechanism of ecological and environmental administrative power is an important part of the operation of national public power in the construction of ecological civilization.This institutional mechanism is currently mainly regulated by the partys internal regulations and institutional system,and lacks unified and clear legal provisions.The shortcomings in the rule of law are reflected in the need to improve institutional design,construct a mechanism system,and supplement normative basis.The legislative improvement and mechanism construction of internal monitoring of ecological and environmental administrative power should be realized through codification.At the technical level of legislation,with the goal of implementing the national environmental protection obligations stipulated in the Constitution,and through the guidance of the theory of functional decentralisation,the internal supervision mechanism of ecological and environmental administrative power should be taken as a safeguard system for the implementation of the local governments responsibility for ecological and environmental protection under the environmental code,and the specific rules should be uniformly constructed in the General Provisions.
