摘　　要：面对帮助信息网络犯罪活动罪的高发态势,准确界定其性质,以防止司法适用的“口袋化”倾向。帮信罪兼具独立性和附属性特征。首先要明确帮信行为是否超越正常业务、是否具有促进犯罪的意图,以区分其附属性与独立性。进一步评估帮信行为与被帮助犯罪的直接因果关系及其可罚性,特别是平衡技术帮助行为的风险与价值。构建评价体系,确立行为次数、金额大小、影响范围等罪量要素,量化标准如支付结算金额和违法所得,判断是否达到刑事责任门槛。合理划定帮信罪与其他罪名的界限,确保有效打击犯罪同时避免过度刑事处罚。In the face of the high incidence of the crime of assisting in cybercrime activities,it is necessary to accurately define its nature to prevent the"pocketization"tendency of judicial application.The crime of assisting in cybercrime activities has both independent and subsidiary characteristics.Firstly,it is necessary to clarify whether the act of assisting in cybercrime activities goes beyond normal business and whether it has the intention of promoting crime,in order to distinguish between its subsidiary and independent characteristics.Further,we should evaluate the direct causal relationship and punishability between the act of assisting in cybercrime activities and the assisted crime,and especially the balance between the risk and value of technical assistance behavior.Whether the criminal liability threshold has been met should be determined by building an evaluation system,establishing factors such as the number of acts,amount of money,and scope of influence,and quantifying standards such as payment settlement amount and illegal gains.The boundary between the crime of assisting in cybercrime activities and other charges should be reasonably delineated,ensuring effective crackdown on crime while avoiding excessive criminal punishment.
