《曼谷规则》背景下我国监狱女犯处遇问题研究

摘　　要：《联合国关于女性囚犯待遇和女性罪犯非拘禁措施的规则》(即《曼谷规则》)是女犯行刑领域最重要的国际法文件,该规则第一次系统提供了一系列指导标准和旨在改善女犯处遇的整套规则。《曼谷规则》确立了女犯处遇原则、内容和保护特点;以《曼谷规则》为背景,说明和分析目前我国监狱行刑中女犯处遇领域的相关制度、规范以及实践做法,观察我国监狱女犯行刑处遇中对性别需求保护的不足;提出监狱工作要真正确立两性平等的行刑观念,并应在顶层设计、行刑成本以及监狱安全政策方面作出一系列具有性别针对性的制度安排。The Bangkok Rules(United Nations Rules for the Treatment of Women Prisoners and Non-custodial Measures for Women Offenders)is the most important document of international law in terms of the treatment of women prisoners,which provides a series of standards and rules to improve the treatment of women prisoners for the first time.The Bangkok Rules sets up the principles,contents and features of protection of the treatment of women prisoners.In the setting of the Bangkok Rules,this article sets forth law systems,disciplines and practices of China in the field of the treatment of women prisoners,identifies the deficiency in protecting the gender needs of women prisoners,and proposes that we should establish gender equality concepts in the execution of punishment and make gender-specific institutional arrangements on legislation perfection,the cost of criminal executing and the policy of prison safety.
