我国海域使用权抵押的规范缺失

摘　　要：《民法典》实施背景下,海域使用权的财产属性和抵押适格性为法律认可,海域使用权抵押也成为活化海域资源价值的重要法律制度。海域使用权根源于国家的所有权,具有公私法交融的权利特性和“公共物品”的财产属性,因而同时受到私法体系和公法体系的规制。此种公私法耦合式的法律体系在价值取向、规范逻辑等方面存在冲突,并具象化为海域使用权抵押制度基础规范体系缺失、权利设定与实现规范供给不足等诸多问题。为此,应立基于海域使用权财产属性的基本立场,理顺海域使用抵押权在我国私法权利中的应然定位,通过法教义学体系解释、归纳、类推等路径实现对海域使用权抵押物权规范体系的重塑,打通海域使用权抵押制度的实践“梗阻”,助力海域使用权经济效益的充分实现。Under the background of the implementation of the Civil Code,the property nature and mortgage eligibility of the right to use marine areas are explicitly recognized by law.The mortgage of the right to use marine areas has become an important legal system for activating the value of marine resources.The right to use marine areas originates from the state’s ownership and has the characteristic of rights intertwined with both public and private law and the property attribute of“public goods”.Therefore,it is regulated by both the private law system and the public law system.This public-private law as a coupled legal system has conflicts in value orientation and normative logic,and concretely manifests itself in the lack of a basic normative system for the mortgage of the right to use marine areas,insufficient supply of norms for the establishment and realization of rights,etc.Therefore,it is necessary to base the basic position of the property nature of the right to use marine areas and clarify the proper position of the mortgage right of the right to use marine areas within the private law system of China through legal hermeneutics,such as interpretation,deduction,and analogy.By reconstructing the property right system of the mortgage of the right to use marine areas through these paths,the practical obstacles to the mortgage system can be removed,and the full realization of the economic benefits of the right to use marine areas can be promoted.
