摘 要:面对城市更新中分散的产权,权利归集能够有效避免“反公地悲剧”的发生,在更新规划的统一引领下,实现城市空间资源的高效利用。权利归集主体呈现多元性的特点,公私主体可依据更新项目特征灵活参与,共同推进更新进程。权利归集客体包括房屋所有权及建设用地使用权、建筑物使用权,权利转移并非权利归集的必要条件。根据是否发生不动产权利转移,可以将权利归集的实现路径区分为物权式的权利归集与债权式的权利归集两类,二者分别适用不同的登记模式。物权式的权利归集导致更新过程中产权主体名实不符,可借助代持或信托关系予以理解,债权式的权利归集则是以委托方式完成城市更新。两种模式各有优劣,均是为应对城市更新,而对既有制度所为的创新之举。In the face of dispersed property rights in urban renewal,rights collection can effectively avoid the occurrence of the"tragedy of the anti-commons",and realize the efficient use of urban space resources under the unified guidance of renewal planning.The subjects of rights collection are diversified,and both public and private subjects can participate flexibly according to the characteristics of the renewal project and jointly promote the renewal process.The objects of rights collection include housing ownership,construction land use right and building use right,and the transfer of rights is not a necessary condition for rights collection.Depending on whether there is a transfer of real estate rights,the realization path of rights collection can be divided into two categories:rights collection in rem and rights collection in debt,which are subject to different registration modes.In-kind rights collection leads to a discrepancy between the name and the reality of the title subject in the renewal process,which can be understood by means of a representative holding or trust relationship,while the creditor's rights collection completes the urban renewal by means of entrustment.Both models have their own advantages and disadvantages,and both are innovations to the existing system in order to cope with urbanrenewal.
