数字法学范畴体系的分层结构与逻辑展开

摘　　要：作为跨法律部门的融合型学科,数字法学范畴体系并不局限于单一层次的范畴结构,而是遵循范畴分层法则的要求,形成基石范畴、基本范畴、具体范畴三阶构造。基石范畴层级的本体论范畴、价值论范畴、方法论范畴,在基本范畴层级转化为对象范畴、价值范畴、方法范畴,在具体范畴层级转化为要素范畴、宗旨范畴、技术范畴。数字法学范畴的分层逻辑,在部门法到领域法范畴、数字法治实践到数字法学理论、法学范畴到法治实践三个层次的演化中,发展出以数字要素为单位的法律规制路径,最终回归于数字私益、数字众益、数字公益的整体协同,数据财产安全、自然人信息人格、算法程序公平区分保护,以及数字私权利、私权力、公权力配置的差序平衡。As a cross-departmental integrated discipline,the category system of digital jurisprudence is not limited to a single-level category structure,but follows the requirements of the law of category stratification,forming a three-order structure of cornerstone category,basic category and specific category.The ontological categories,axiological categories,and methodological categories at the cornerstone category level are transformed into object categories,value categories,and method categories at the basic category level,and into the element categories,purpose categories,and technique categories at the level of specific categories.The hierarchical logic of the digital jurisprudence category,in the evolution of the three levels from departmental law to domain law category,digital rule of law practice to digital jurisprudence theory,and jurisprudence category to rule of law practice,has developed a legal regulatory path based on digital elements,and finally returned to the overall coordination of digital private interests,digital public benefits,and digital public welfare,the fair distinction and protection of data property security,natural person information personality,and algorithm procedures,as well as the differential order balance of digital private rights,private rights,and public power allocation.
