行政许可要件契约化的限定及其制度构造

摘　　要：基于行政许可目的性要件和管理性要件的分类基础,在行政许可中嵌入许可要件契约化制度,以满足行政机关完成行政任务的需要。合作行政的兴起、规制工具的革新和行政效率的需求是支撑行政许可要件契约化制度的法理基础。行政许可要件契约化的范围限于管理性要件,在行政许可要件契约化的容许性上采用“有限说”。行政许可要件契约化要约由公开、告知两项内容构成,行政许可要件契约化承诺涉及申请人条件、申请人接受表示、行政机关确认和承诺退出机制。行政许可要件契约化的监管可以分为事先审查和事后核查。作为强化行政许可要件契约化监管的补充机制,失信惩戒不可或缺。Based on the classification of purposive and managerial requirements of administrative licensing,a contractual system of licensing requirements is embedded into the administrative licensing system to meet the needs of administrative organs in completing administrative tasks.The rise of cooperative administration,the innovation of regulatory tools,and the demand for administrative efficiency are the legal basis that supports the contractual system of administrative licensing requirements.The scope of the contractualization of administrative licensing requirements is limited to management requirements.The‘limited theory’should be adopted in the permissibility of the contractualization of administrative licensing requirements.The contractual offer of administrative licensing requirements consists of two components:public disclosure and notification.The contractual commitment of administrative licensing requirements involves the applicant's conditions,the applicant's expression of acceptance,the administrative organ's confirmation,and the withdrawal commitment mechanism.The regulation of the contractualization of administrative licensing requirements can be divided into pre-examination and post-verification.As a supplementary mechanism to strengthen the contractual supervision of administrative licensing requirements,punishment for dishonesty is indispensable.
