摘　　要：随着我国快速地步入老龄化社会,涉老年人与养老服务机构间养老服务合同的纠纷也与日俱增。依托“中国裁判文书网”上的相关案例,归纳了实务中常见的纠纷类型,从养老服务合同拟定的角度探讨养老服务产业的风险防范问题,提出了关于合同的签署主体、照护等级、冷静期、免责条款等七大方面的完善建议,以期能为养老机构化解经营风险提供思路和借鉴,促进养老服务产业的健康发展,让广大老年人群体享受到更优质的社会养老服务。As China rapidly ages,disputes involving elderly care service contracts between the elderly and elderly care service institutions are also increasing.Based on relevant cases from“China Judgment Online,”common types of disputes in practice and discusses risk prevention in the elderly care service industry are summarized from the perspective of contract formulation.It proposes seven major suggestions for improvement,including the signing parties of the contract,care levels,cooling-off periods,exemption clauses,and other aspects.The aim is to provide ideas and references for elderly care institutions to resolve operational risks,promote the healthy development of the elderly care service industry,and enable the elderly population to enjoy higher-quality social elderly care services.
