摘  要:基于区块链技术的NFT数字作品具有确权优势,成为著作权保护的新形态。区块链的信任机制能够保证作品上链后版权信息的不可篡改,但当原作品存在著作权瑕疵时,NFT数字作品仍然面临侵犯复制权和信息网络传播权风险。数字时代的网络著作权侵权治理亟须实现从行政监管向平台共治的范式转型,这一转向得到了现有规范性文件、行政监管策略以及司法判例的支持。当下NFT数字作品平台在防治著作权侵权中的职能角色与责任承担范围并不合理,“避风港原则”与“红旗原则”不应被视为其免责的正当性理据。基于平台的控制能力和营利模式等因素,NFT数字作品平台应当构建与完善著作权审核机制,并在获知侵权线索后及时采取必要措施遏止侵权结果的扩散。NFT digital works based on blockchain technology possess advantages in rights confirmation,emerging as a new form of copyright protection.The trust mechanism of blockchain ensures the immutability of copyright information once a work is recorded on the chain.However,if the original work has copyright defects,NFT digital works still face risks of infringing the right of reproduction and communication through information network.In the digital era,gover-nance of online copyright infringement urgently requires a paradigm shift from administrative regulation to platform co-governance.This transition is supported by existing normative documents,administrative regulatory strategies,and ju-dicial precedents.Currently,the role and responsibility scope of NFT digital work platforms in preventing copyright in-fringement are not adequately defined.The"safe harbor principle"and"red flag principle"should not be regarded as justifications for their exemption from liability.Considering factors such as platform control capabilities and profit mod-els,NFT digital work platforms should establish and refine copyright review mechanisms,and promptly take necessary measures to curb the spread of infringement once infringement clues are identified.
