欧洲统一专利制度探析及启示研究  

Analysis and Enlightenment of the European Unitary Patent System

摘　　要：欧洲统一专利制度历经几十年的建设在2023年6月1日正式落地实施,统一专利制度的法律体系和审理机制对欧洲专利的保护具有明显的制度优势。目前,我国知识产权案件专门化审判机构的设置和配套制度仍不完善,客观上对我国知识产权司法体制改革产生了负面影响。未来,我国可以借鉴欧洲统一专利的制度安排深化我国知识产权审判机制改革,制定知识产权法院案件审理程序规则,建立符合知识产权案件特点的审判组织和审判规则。此外,可继续组建中级人民法院层级的知识产权一审法院,将最高人民法院知识产权法庭独立出来,建立专门的技术类知识产权案件上诉法院。同时,借助法院司法审查的力量,限制性地允许知识产权法院审查专利的效力,合理分配专利行政部门和法院之间的专利效力审查权。After decades of construction,the European unitary patent system was officially imple-mented on June 1,2023.Its new legal system and trial mechanism have obvious institutional advantages for protecting European patents.In contrast,specialized trial agencies for intellectual property cases in China remain underdeveloped and lack adequate supporting systems,which has hindered the reform of China’s intellectual property judicial system.Looking ahead,China can draw lessons from the institu-tional arrangements of the European unitary patent to deepen the reform of its intellectual property trial mechanisms,formulating procedural rules for hearing cases in intellectual property courts and developing trial organizations and rules that align with the unique characteristics of intellectual property matters.Ad-ditionally,it is essential to establish intellectual property courts of first instance at the intermediate peo-ple’s court level,separate the intellectual property court from the Supreme People’s Court,and create specialized appeals courts for technical intellectual property cases.Furthermore,with the power of judi-cial review by the courts,intellectual property courts should be empowered to conduct limited judicial reviews of patent validity and the power of patent validity review should be reasonably allocated between the patent administrative departments and the courts.
