元宇宙图书馆的信息安全问题及其法律治理研究

摘　　要：元宇宙图书馆是由物理层、技术层和职能层融合而成的三元架构,其内部信息自由流动形成了元宇宙图书馆虚实结合的数字生态。元宇宙图书馆作为用户身份匿名、行为算法驱动、内容全员创造和管理去中心化的虚拟空间,面临网络安全、数据安全、用户隐私等信息安全问题,而利用法律手段应对元宇宙图书馆信息安全问题也存在现行法律规制不足、空间自治弱化国家主权治理、用户身份匿名导致其法律治理对象不易被识别等挑战。基于此,文章提出软法治理与硬法治理相统一的法律治理路径:完善元宇宙图书馆信息安全问题的法律治理规则体系,规制元宇宙图书馆权力以强化国家治理主体地位,开启用户身份实名认证以精准识别法律治理对象。试图对元宇宙图书馆信息安全法律治理进行系统谋划,从而为元宇宙图书馆信息生态和谐及健康发展提供制度保障。The metaverse library is a tripartite structure composed of physical layer,technical layer and functional layer.The free flow of internal information in the metaverse library forms the digital ecology of virtual and real combination.As a virtual space with anonymous user identity,algorithm-driven behavior,content creation by all and management decentralization,the metaverse library is faced with information security problems such as network security,data security and user privacy.However,the use of legal means to deal with the information security problems of the metaverse library also has challenges such as insufficient existing legal regulations,the weakening of national sovereignty governance by space autonomy,and the anonymity of user identity which makes it difficult to identify the object of legal governance.Based on this,this paper puts forward the legal governance path of the unity of soft law governance and hard law governance:improving the legal governance rule system of the information security problem of the metaverse library,regulating the power of the metaverse library to strengthen the main position of national governance,and opening the users′identity real name authentication to accurately identify the object of legal governance.This paper attempts to systematically plan the legal governance of information security in metaverse library,so as to provide institutional guarantee for the harmonious and healthy development of information ecology in metaverse library.
