数字技术创新赋能开源社区知识产权治理的生发逻辑、体系构建与实践路径

摘　　要：伴随大数据、区块链和人工智能等新一代数字技术的加速创新,数字技术成为开源社区知识产权治理的有效工具,对推动开源生态高质量发展具有重要意义。立足中国式现代化背景,分析数字创新和开放式创新发展下开源社区存在的知识产权问题和治理需求,探究在数字技术创新外部契机下开源社区知识产权治理的生发逻辑。基于系统论和活动理论三角形模型,建构数字技术创新赋能开源社区知识产权治理体系框架,明确治理目标、治理客体、治理主体和治理方式。结合危机三阶段理论提出数字技术创新赋能开源社区知识产权事前、事中和事后治理运行流程。结合活动理论下的体系要素互动特征和子系统,提出发挥制度优势夯实基础、革新数字技术提升动能和协同共治凝聚主体的不同实践路径。研究旨为开源创新体系建设和知识产权治理现代化提供理论参考和实践借鉴。With the accelerated innovation of new generation digital technologies such as big data,blockchain and artifi⁃cial intelligence,digital technology has become an effective tool for intellectual property governance in open-source commu⁃nities,which is of great significance for promoting the high-quality development of open-source ecosystems.Based on the background of Chinese path to modernization,this paper analyzes the intellectual property issues and practical needs of open-source communities under the development of digital innovation and open innovation,and explores the logic of intel⁃lectual property governance in open-source communities under the external opportunities of digital technology innova⁃tion.Based on the system theory and the activity theory hexagonal model,a framework for the intellectual property govern⁃ance system of open-source communities enabled by digital technology innovation is constructed,clarifying the governance objectives,governance objects,governance subjects,and governance methods.Based on the three-stage theory of crisis,this paper proposes a process for the pre-emptive,ongoing,and post-emptive governance of intellectual property rights in opensource communities enabled by digital technology innovation.Based on the interactive characteristics of system elements and subsystems under the activity theory,different practical paths are proposed to leverage institutional advantages to consolidate the foundation,innovate digital technology to enhance momentum,and collaborate to unite the main body.The research aims to provide theoretical reference and practical reference for the construction of open-source innovation system and the mod⁃ernization of intellectual property governance.
