摘 要:神经科技创新所内含的技术和操作风险,甚至有诱发系统性风险之可能,迫使监管者必须给予有力回应。然而,固有的信息不对称、伦理审查弹性较差和法律滞后等问题,使得以普适性伦理审查和法律惩戒为核心构建的传统二维监管体系无法有效应对芯片入脑的“人机共生”交互进化的技术特质,因此必须在伦理和法律监管维度之外增加智能维度,形塑三维监管体系。智能维度的监管致力于依靠“智能技术体系”构建精准性和限时性监管,以数据驱动为核心,构筑起精细化脑芯片数据采集和解码系统、阶段性技术风险预警机制和敏捷监管反馈循环,突破了传统科技监管的困局,创新了监管方式,实现了技术发展安全与效率的平衡。The inherent technological and operational risks associated with innovations in neural technology,which may even trigger systemic risks,necessitate a robust response from regulators.However,issues such as inherent information asymmetry,limited flexibility in ethical reviews,and legal lags render the traditional two-dimensional regulatory framework-centered on universal ethical review and legal sanctions-ineffective in addressing the unique technological traits of the“human-machine symbiosis”resulting from brain chip integration.Therefore,it is imperative to augment the existing ethical and legal dimensions with an intelligent dimension,thereby shaping a three-dimensional regulatory system.This intelligent dimension of regulation aims to leverage an“intelligent technology system”to establish precise and time-bound regulations.With a data-driven approach at its core,it encompasses a refined data collection and decoding system for brain chips,a phased technical risk warning mechanism,and an agile regulatory feedback loop.This innovation breaks through the inherent dilemmas of traditional technology regulation,enhances regulatory methods,and strikes a balance between safety and efficiency in technological development.
