文博机构数智创新的版权应对

摘　　要：在现代信息技术的催生下,文博机构开展数智化创新已然成为行业共识,其具体实践呈现为数智化保护、展览、管理、教育等。文博机构的数智创新,面临版权确权层面的成果可版权性争议与权利主体争议、版权授权层面的授权管理与合理使用问题,以及版权侵权层面的侵权认定困难和维权现实障碍。有鉴于此,文博机构一方面应明确数字版权归属、完善动态版权授权机制、强化版权维权能力,另一方面也应在运用现代版权技术手段、增强版权宣传教育普及方面有所作为。With the emergence of modern information technology,it has become an industry consensus for cultural institution to carry out digital intelligent innovation,and its specific practice presents digital intelligent protection,exhibition,management,education and so on.The digital intelligence innovation of cultural and museological institution has encountered the disputes over the copyright of achievements and rights subjects at the level of copyright confirmation,the problems of authorization management and fair use at the level of copyright authorization,and the difficulties in the identification of copyright infringement and the practical obstacles in safeguarding rights at the level of copyright infringement.In view of this,on the one hand,cultural institution should clarify the ownership of digital copyright,improve the dynamic copyright authorization mechanism,and strengthen the ability to protect copyright right.On the other hand,they should also make a difference in the use of modern copyright technology and enhance the popularization of copyright publicity and education.
