摘　　要：实验法理学以思想实验为基点,通过对广泛的思维判断进行经验研究,来反思、深化法理学命题,是一种新兴的法理学研究路径。实验法理学奠基于深厚的法理学传统,从实验对象、实验方法和实验取向三个层面探索了法理学研究的大众性、科学性和反思性,因而是必要的。实验法理学沟通了理性世界和经验世界,具备充足的理论资源和高效的现实工具,因而是可行的。当今的实验法理学呈现出一种总体议题、具体问题与本土语境之间的互动,既随时代发展而不断拓展,又限于学科品性须保持必要的限度。一方面,实验法理学无法取代传统概念分析和规范分析理论,其面对的仍是经典法理学问题;另一方面,实验法理学又为法理研究与社科知识的结合提供了一条新进路,使其相互关联、相互成就。总的来说,实验法理学既面临诸般挑战,又具备广泛的前景。Experimental jurisprudence is an emerging approach to jurisprudential studies based on thought experiments.It expounds and delves into jurisprudential propositions through empirical research on a wide range of cognitive judgments.Rooted in the rich heritage of jurisprudence,experimental jurisprudence is highly valuable in that it explores the folklity,scientificity,and reflectiveness of jurisprudence from the perspectives of the objects,methods and orientation of experiment.Experimental jurisprudence bridges the rational world and the empirical world,and is feasible as it is endowed with ample theoretical resources and highly-effective practical tools.Contemporary experimental jurisprudence is characterized by interactions between overarching themes,specific issues,and local contexts,continuously expanding with the development of the times while remaining within necessary limits dictated by its nature as an academic discipline.On one hand,experimental jurisprudence cannot replace traditional conceptual and normative analyses,as what it is purported to address remains classical jurisprudential questions;on the other hand,it provides a new approach to the integration of jurisprudence and social sciences,allowing for mutual connection and enrichment between the two.Overall,experimental jurisprudence is faced with both challenges and promising prospects.
