摘 要:随着数字科技与金融服务深度融合,个人金融数据跨境流动趋势急剧扩大。为有效管理数据流动,全球各国通过法律体系加强对个人数据跨境流动的监管,旨在有效管理本国数据资源。然而,当前我国传统的金融分业监管模式已无法适应这一变化,导致在个人金融数据跨境流动监管方面面临诸多困难。通过分析分业监管与数据流动之间的制度冲突,并在此基础上,提出在我国现有法律框架下,调整传统监管模式,实施统一监管,以平衡数据保护与流动自由之间的矛盾,从而提高跨境数据流动的监管效果。With the deep integration of digital technology and financial services,the trend of cross-border flow of personal financial data has expanded dramatically.In order to effectively manage data flows,countries around the world have strengthened the regulation of cross-border flows of personal data through their legal systems,aiming to control their own data resources.However,China’s traditional financial regulation model has been unable to adapt to this change,resulting in many difficulties in regulating the cross-border flow of personal financial data.This paper analyzes the institutional conflict between the separation supervision and data flow,and on this basis,proposes to adjust the traditional supervision mode and implement unified supervision under the existing legal framework in China,so as to balance the contradiction between data protection and freedom of movement,so as to improve the supervision effect of cross-border data flow.
