摘　　要：“双碳”目标是否写入以及如何写入“国土空间规划法”是国土空间规划法治建设和“双碳”目标法治保障研究领域的关键问题。通过对现有的规范性文件和国土空间规划实践进行检视,可以采用“系统融入+专项嵌入”的“双碳”目标全方位融入“国土空间规划法”的立法模式,通过明确“双碳”目标的周期性和空间性原则,构建规范表达的专门性制度体系。通过提出程序性与实体性并重的立法体例优化方案,完善相关部门行政事权配置,科学设置法律责任,做好“国土空间规划法”与能源立法、生态环境法典编纂等立法工作的衔接,为“双碳”目标的实现提供国土空间规划保障。Whether and how the"dual-carbon"goals could be included in the territorial spatial planning law(TSPL)is a crucial issue in the construction of the rule of law for territorial spatial planning(TSP).By reviewing the existing legal documents and the practice of TSP,the legislative mode of"systematic integration+special embedding"can be adopted to integrate the"dual-carbon"goals into the TSPL in a comprehensive way.By clarifying the principles of periodicity and spatiality of the"dual-carbon"goals,a specialized system of"dual-carbon"regulations will be constructed.By proposing a legislative optimization plan that emphasizes both procedural and substantive aspects,improving the allocation of administrative powers of the relevant departments,scientifically setting up legal responsibilities,and making sure that the TSPL is well connected with energy legislation,the codification of ecological and environmental codes.The above measures provide a guarantee of TSP for the realization of the"dual-carbon"goals.
