摘 要:在数字经济蓬勃发展的背景下,新业态劳动者群体正在不断发展壮大,但新业态劳动者的职业伤害风险仍然缺乏完备有效的保障。当前,新业态劳动者职业伤害保险试点正广泛展开,基本模式大致可以归纳为直接纳入工伤保险模式、单险种参加工伤保险模式、非工伤保险模式三类。基于新业态劳动者职业伤害保险模式的归类与比较,本文建议采取较为宽松的标准来界定劳动关系、突破传统职业伤害认定规则、增强社会企业责任意识,进一步完善新业态劳动者职业伤害保险体系,以实现劳有所保,促进社会的公平与稳定。Against the backdrop of the booming development of the digital economy,the group of new forms of workers is constantly growing and expanding,but the occupational injury risks of workers in new business formats still lack comprehensive and effective protection.At present,pilot programs for occupational injury insurance among workers in new business formats are widely launched,and their basic models can be roughly classified into three categories:direct enrollment in work-related injury insurance,participation in work-related injury insurance as a single insurance category,and non-work-related injury insurance schemes.On the basis of classifying and comparing the occupational injury insurance models for new forms of workers,it is recommended to adopt more relaxed standards to define labor relations,break through traditional occupational injury recognition rules,strengthen social enterprise responsibility awareness,further improve the occupational injury insurance regime for new forms of workers,in order to achieve labor insurance and promote social fairness and stability.
