数字经济时代人工智能创作物版权治理的范式重塑

摘　　要：在数字经济时代,人工智能创作物的作品信息价值、辅助创作价值与数据资源价值得以更好展现。而受到ChatGPT等大型语言模型、Disco Diffusion等AI绘画模型飞速发展的影响,数字经济中人工智能创作物引发的治理挑战也更加具体地得以呈现。对此,应更好解决人工智能创作物的版权保护难题、更好消除人工智能创作中的权利失衡风险、更好回应版权滥用等现象,使版权治理更加适应数字经济时代需求。应从保护新型商业模式、回应社会新变革等角度推进版权法理论创新,进而基于人工智能创作物的客体地位与使用规则等构建保护模式,完善人工智能创作中对人类作者的保护,并加强版权制度与人工智能、数据产权等制度的协同性,实现从理论转型到具体路径的治理范式重塑。In the era of digital economy,the work information value,auxiliary creation value and data resource value of artificial intelligence creation can be better displayed.Influenced by the rapid development of large-scale language models such as ChatGPT and AI painting models such as Disco Diffusion,the governance challenges caused by artificial intelligence creation in the digital economy are getting more specified.In this regard,we should better solve the copyright protection problem of artificial intelligence creatios,better eliminate the risk of copyright imbalance in artificial intelligence creation,better respond to copyright abuse and other phenomena,so that copyright governance can better adapt to the needs of the digital economy era.We should promote the theoretical innovation of copyright law from the perspective of protecting new business models and responding to new social changes,then build a protection model based on the object status and the use rules of artificial intelligence creation,improve the protection for human authors in artificial intelligence creation,and strengthen the synergy among copyright system’artificial intelligence,data property rights and other systems to reshape governance paradigm by transforming theories to concrete path.
