摘　　要：域外法查明是國際私法的基礎問题,也是涉外民商事審判中的重要問题,對於平等保護中外當事人合法權益、展现國家司法形象、促進國際民商事交往具有重要意羲。随著我國對外經濟贸易活動持續活躍,人民法院審理的涉外民商事案件涉及的法域明顯增多,域外法查明的需求持續增長。Foreign law ascertainment is a basic issue of private international law as well as an important issue in foreignrelated civil and commercial trials.It is of great significance for equally protecting Chinese and foreign parties'legitimate rights and interests,showing China's judicial image,and promoting international civil and commercial exchanges.
