国际体育组织赛事垄断的法律规制——基于欧超联赛公司诉UEFA&FIFA案的分析

摘　　要：欧超联赛公司诉UEFA&FIFA案是对国际体育组织赛事垄断发起的法律挑战,也是涉及欧盟法如何适用于体育领域的案件。运用文献资料法、比较法、案例分析法等方法,基于欧盟法院对欧超联赛公司诉UEFA&FIFA案裁决,对该案的裁决要点和该案对欧洲体育发展的影响进行了分析,并就该案对我国的启示进行了探讨。研究发现:欧盟法院在欧超联赛公司诉UEFA&FIFA案中就欧盟法对体育调整范围进一步的进行了确定,否定了《欧盟运行条约》第165条相较于其他条款所具有的宪法性的地位,该条所体现的“体育特殊性”不能作为直接获得欧盟法“豁免”的依据。UEFA&FIFA章程中的“授权规则”构成一项经济活动而属于欧盟法的适用范围。欧超联赛公司诉UEFA&FIFA案表明了欧盟法对体育事务的介入进一步强化。该案对我国体育发展亦有重要的启示。The case of the European Super League Company vs.UEFA&FIFA poses a legal challenge to the monopoly of events organized by international sports organizations and is also a case concerning the application of EU law in the field of sports.This paper employs research methods such as literature review,comparative analysis,and case study analysis to analyze the key points of the judgment and its impact on European sports development,based on the decision of the Court of Justice of the European Union(CJEU)in the European Super League Company vs.UEFA&FIFA case.It also discusses the implications of the case for China.The study finds that the CJEU,in the case of the European Super League Company vs.UEFA&FIFA,further clarified the scope of EU law's adjustment to sports,negating the constitutional status that Article 165 of the Treaty on the Functioning of the European Union(TFEU)compared to other provisions.The“specificity of sport”reflected in Article 165 cannot serve as a basis for directly obtaining an“exemption”from EU law.UEFA&FIFA's“authorization rules”constitute an economic activity and therefore fall within the scope of application of EU law.The case of the European Super League Company vs.UEFA&FIFA demonstrates an intensified involvement of EU law in sports affairs.The case also has significant implications for the development of sports in China.
