摘　　要：同为19世纪的思想家,黑格尔和马克思都关注到了近代市民社会结构转型对社会联合的影响,也正是在市民社会问题上,马克思与黑格尔展开交锋。承接英国古典政治经济学对现代社会生产和交换关系的阐发,黑格尔以法哲学的政治方案来应对市民社会以私人所有权确立社会主体性的社会联合问题。马克思基于对市民社会政治构成的批判,将黑格尔法哲学和英国古典政治经济学理论语境之中的市民社会还原为私有财产的现代法权关系,在追溯资本主义生产方式和现代资产阶级社会形成史的过程中揭示市民社会结构的历史起源及其观念塑造,探索突破市民社会结构之历史性的现实路径。As thinkers in the 19th century,Hegel and Marx both paid attention to the influence of the structural transformation of modern civil society on social union,and it was precisely on the issue of civil society that Marx and Hegel confronted themselves.Inheriting the elucidation of the relationship between production and exchange in modern society by British classical political economy,Hegel designed the political scheme of legal philosophy to deal with the social union problem of social subjectivity of civil society by private ownership.Based on the criticism of the political composition of civil society,Marx reduced the civil society in the context of Hegel’s legal philosophy and British classical political economy theory to the modern legal right relationship of private property.Marx revealed the historical origin and concept shaping of civil society structure in the process of tracing the capitalist mode of production and the formation history of modern bourgeois society.
