摘　　要：《未成年人网络保护条例》已于2023年经国务院颁布施行,这是我国首部未成年人网络权益保障领域的专门性综合立法,标志着世界眼光和中国特色兼具的未成年人网络保护规范体系的基本建成。在层次架构上,我国未成年人网络保护规范体系包括以《中华人民共和国网络安全法》专条、《中华人民共和国未成年人保护法》专章、《未成年人网络保护条例》为核心的一系列法律法规规章等规范性文件,实现了宏观与微观的一以贯之、总体结构的完整周延。在内在逻辑上,我国未成年人网络保护规范体系旨在全面保障网络空间中未成年人的权利,通过赋能与保护提升未成年人网络法治水平。作为行政法规,《未成年人网络保护条例》上承法律,下揽规章政策,对规范体系的发展完善发挥着至关重要的作用,从其创新设置平台实名制、未成年人模式、网络欺凌防控智能化、头部平台核心义务四项先进制度,可见一斑。In 2023,the State Council promulgated the Regulations on the Protection of Chlidren on Line,which is the first specialized comprehensive legislation on the protection of children's network rights in China,marking the basic completion of the normative system for the protection of children on line with a world vision and Chinese characteristics.In terms of hierarchical structure,China's normative system for the protection of children on the Internet includes a series of laws,regulations and other normative documents centered on the special articles of the Network Security Law,the special chapter of the Law on the Protection of Children,and the Regulations on the Protection of Chlidren on Line,which have realized the consistency of the macroscopic and microcosmic aspects as well as the completeness of the overall structure.In terms of interma logic,China's normative system for the protection of children on the lnternet aims to comprehensively safeguard the rights of children in cyberspace,and to enhance the level of the rule of law for children on the Internet through empowerment and protection.As an administrative law,bearing the law above and the regulations and policies below,the Regulations play a crucial role in the development and improvement of the normative system,as evidenced by its innovative setting of four advanced systems such as real-name platforms,children's model,intelligent cyberbullying prevention and control,and core obligations of head platforms.
