片面对向犯处罚依据的反思与重构

摘　　要：片面对向犯作为刑法理论和实践中的疑难问题,其处罚依据在学界始终聚讼纷纭。基于各自的立场,不同的学说尝试从不同角度阐释片面对向犯的处罚依据,虽具有一定的合理性,但也存在着不同程度的缺陷。当前的诸理论学说只是孤立地、一元化地剖析片面对向犯的处罚依据,不仅没有从根本上解决问题,反而造成了理论学说的纷争和司法适用的混乱。片面对向犯作为对向犯的特殊类型,其处罚依据应回归至共犯的处罚依据,通过比较共犯处罚依据的学说,明确以混合的惹起说为基础来建构我国刑罚体系中片面对向犯的处罚依据,即对片面对向犯中未被我国现行刑法典规定的必要参与行为作出实质违法性的判断,进而依据刑法总则关于共犯(教唆犯、帮助犯)的规定来定罪处罚。The problem of the unilateral punishment for the offender has always been a difficult issue in criminal law legislation,judicial practice,and theoretical research.The controversy over the basis for punishment has been a subject of heated debate among scholars,with different schools of thought presenting their own perspectives based on their own positions and explaining the basis for the unilateral punishment for the offender from different angles.Although these perspectives have certain rationality,they also have certain degrees of defects.The current theoretical schools of thought only view the unilateral punishment for the offender in isolation and one-dimensionally,which not only fails to solve the problem fundamentally,but also causes the dispute among theoretical schools and confusion in judicial application.As a special type of reciprocal accomplice,the basis of the unilateral punishment for the offender should be returned to the basis of punishing accomplices.By comparing the theories of punishing accomplices,it should be clarified that the basis for the unilateral punishment for the offender should be constructed based on the mixed arousal theory,making a substantive judgment on the necessary participatory behavior that is not stipulated by the criminal law,and finally punishing it according to the provisions of the general principles of criminal law.
