摘　　要：数字经济时代的刑法归责应强化作为治理中介和权力中轴的网络平台的责任。以个人作为主要风险分配对象的个人化风险归责模式存在与网络犯罪的结构不符、没有衔接前置法的义务体系、缺乏多元治理的刑法保障等误区。网络平台管理者与被管理者的双重属性决定了其是网络犯罪治理过程中,最为重要的风险诱发和风险控制节点。数字经济时代的刑事归责,必须以强化网络平台刑事责任为根本方向,在构筑风险防范机制(网络平台独立归责)和防范用户在其控制领域内实施犯罪(网络平台与个人的共同归责)两端共同发力,实现网络犯罪的源头治理和风险控制。In the digital economy era,the criminal law attribution system should emphasize the responsibilities of network platforms as governance intermediaries and power hubs.The personalized risk imputation model,which primarily focuses on individuals as the main risk allocation entities,suffers from several shortcomings:it does not align with the structure of cybercrime,lacks connection to the obligation systems in the pre-positioned laws,and fails to provide a criminal law framework for pluralistic governance.Network platforms,as both the governor and the governed,serve as critical nodes in both risk inducement and risk control during cybercrime governance.Criminal law attribution in the digital economy era must prioritize strengthening the criminal responsibilities of network platforms.This entails developing independent attribution mechanisms for risk prevention by platforms and establishing shared responsibility between platforms and individuals to prevent crimes within the platforms control.Together,these efforts aim to achieve source governance and risk control of cybercrime.
