摘 要:当前,许多国家都将虚假信息列为威胁国家安全的重大风险因素,采取立法手段加以管制。研究国外管制虚假信息的立法进展,有助于把握当下最新的治理动态,为管制虚假信息、制定具体规则提供参考。由于立法管制虚假信息存在范围难以界定的问题,执法过程存在行为者意图难以证明、社会危害和程度难以归因和衡量等障碍,仅靠法律手段无法有效解决虚假信息引发的安全问题,故在具体规制上应明确公权力介入的边界,审慎使用刑法,要在平衡自由与秩序的基础上寻求一条综合、开放、合作的虚假信息治理之路。At present,many countries list false information as a major risk factor that threatens national security and adopt legislative means to control it.Studying the legislative progress in controlling false information in foreign countries is helpful to grasp the latest governance dynamics and provide reference for the control of false information and the formulation of specific rules.As the scope of legislation to control false information is difficult to define,there are obstacles in the process of law enforcement,such as the intention of actors is difficult to prove,the social harm and degree are difficult to attribute and measure,and the security problems caused by false information cannot be effectively solved by legal means alone.Therefore,in the specific regulation,the boundary of public power intervention should be clarified,the criminal law should be used cautiously,and a comprehensive,open and cooperative way of false information governance should be sought on the basis of balancing freedom and order.
