大数据视域下网络传销犯罪问题研究

摘　　要：进入二十一世纪以来,随着互联网的高速发展,网络传销犯罪逐渐增多。相较于传统的传销犯罪案件,网络传销犯罪则具有智能化、隐蔽化、网络化、扁平化的特点,破坏了正常的社会秩序,影响了社会稳定,危及了人民群众的人身财产权利。而在办理网络传销案件时,又存在着证据固定、如何追赃等诸多难点。在“互联网+”时代,应高效应用大数据,将社会各种资源衔接起来,建立公安机关、互联网企业、银行与第三方支付平台等多方参与的治理体系,消除网络传销犯罪产生的土壤和条件,从而更精准的打击网络传销犯罪。Since entering the 21st century,with the rapid development of the Internet,online pyramid sell⁃ing crimes have gradually increased.Compared to traditional pyramid schemes,online pyramid schemes have the characteristics of intelligence,concealment,networking,and flattening,which disrupt normal social order,affect social stability,and endanger the personal and property rights of the people.In handling cases of online pyramid schemes,there are many difficulties such as fixed evidence and how to recover stolen goods.In the era of"Internet plus",through the efficient application of big data,various social resources are connected,and a governance system involving public security organs,Internet enterprises,banks and third-party payment platforms is established to eliminate the soil and conditions for the emergence of on⁃line pyramid selling crimes,so as to more accurately combat online pyramid selling crimes.
