“帮信罪”与“掩隐罪”的刑法教义学界分

摘　　要：随着网络犯罪的不断涌现,当前司法实践对帮助信息网络犯罪活动罪与掩饰、隐瞒犯罪所得罪的认定存在“主观随意、界分不明、相互混同”的异化现象。为加强对网络犯罪的精准打击,体现罪责刑相适应,有必要从实质要素、评价要素与定罪量刑三个维度来厘清两罪的界限。具体而言,实质要素强调两罪性质与保护法益,可以在上游犯罪既遂之前排除掩饰、隐瞒犯罪所得罪的适用空间;评价要素通过对客观行为与主观明知进行解析,能将两罪分别进行主、客观构成要件项下的分流归置;定罪量刑则是突出两罪的想象竞合关系,考虑以“宣告刑”作为“择一重”处断的判断标准。通过此种逻辑区分路径,可以消解司法机关打击相关网络犯罪的程序性困境,提升司法效能,统一法律适用。With the continuous emergence of cybercrime,there exists an abnormal phenomenon characterized by“subjective arbitrariness,unclear demarcation,and mutual confusion”in the current judicial practice regarding the identification of the crime of assisting information network criminal activities and the crime of concealing or disguising criminal proceeds.In order to strengthen the precise combat against cybercrime and reflect the appropriateness of crime and punishment,it is necessary to clarify the boundaries between the two crimes from three dimensions:substantive elements,evaluative elements,and conviction and sentencing.Specifically,the substantive elements emphasize the nature of the two crimes and the protection of legal benefits they protect,which can exclude the application scope of the crime of concealing or disguising criminal proceeds before the attempt of the predicate crime.The evaluative elements,by analyzing the objective behavior and subjective knowledge,can classify and place the two crimes under the subjective and objective constitutive elements respectively.Conviction and sentencing highlight the imaginative joinder relationship between the two crimes,with “declared punishment” considered as the judgment standard for choosing the heavier punishment.Through such a logical differentiation path,the procedural dilemmas of the judicial authorities in combating related cybercrimes can be eliminated,judicial effectiveness enhanced and the application of the law harmonized.
