城市更新立法实证样本纵横检视及三阶体系构建

摘　　要：从我国城市更新立法的发展历史观之,全国层面并未有统一的城市更新专项法律法规,少部分省市出台相应地方性法规或地方政府规章,大部分为行政规范性文件,立法供给不足,法律位阶失衡。从城市更新地方立法的区域差异观之,东部以及南部城市的地方立法已完成第一轮改革,而西部以及少数民族地区的城市更新地方立法还未开启。据此提出顺应《立法法》修改的契机和精神,将地方试验立法的成熟经验及时上升为国家法律,设区的市根据地方实际创新制度安排,在法律之外强化行政规范性文件的配套细则,构建国家立法+地方立法+配套规范性文件的立法体系,形成可复制推广的制度经验,为建设现代化美好城市提供法治支持。From the historical perspective of the development of China’s urban renewal legislation,there is no unified set of special laws and regulations on urban renewal at the national level.Only a few provinces and cities have issued corresponding local rules or local government regulations,most of which are administrative normative documents.Legislation is under-supplied and legal hierarchy is imbalanced.In terms of regional differences in the local legislation on urban renewal,the first round reform has been completed in the eastern and southern cities,while the urban renewal local legislation in the western and ethnic minority areas has not yet been initiated.In this case,the paper proposes to conform to the opportunity and spirit of the revision of“the Legislative Law”,upgrade timely the mature experience of local experimental legislation into national law,develop innovations of institutional arrangements according to local reality in cities divided into districts,and strengthen the supporting rules for administrative normative documents beyond the law.It is important to build a three-level legislative system including national legislation,local legislation and supporting normative documents,so as to generate replicable and promotable institutional experience and provide legal support for the construction of modern and beautiful cities.
