论WTO上诉仲裁的常态化运行

摘　　要：上诉机构重启后,WTO上诉仲裁的常态化运行对WTO争端解决机制的发展意义深远。依据《维也纳条约法公约》的解释规定对DSU第25条进行解释,作为替代性争端解决方式,DSU第25条仲裁具备替代上诉审议程序的合法效力,这为上诉仲裁常态化运行提供了法律依据。上诉仲裁的常态化运行契合WTO争端解决机制防范失灵风险以及追求更高层次发展的制度需要,对WTO争端解决机制的改革优化具有积极意义。上诉仲裁机制的良好运行态势为其常态化运行创造了有利的现实条件,在未来推进上诉仲裁常态化运行的过程中,需厘清上诉仲裁与上诉审议程序间的程序平行与实体协同关系,并妥善解决上诉仲裁实现常态化运行需考虑的诸多问题,包括仲裁员与仲裁秘书的聘用、资金的筹措与配置、程序规则范本的拟定以及裁决一致性的严格保障等。After the reactivation of the Appellate Body,the normalized operation of WTO Appellate Arbitration would have a far-reaching impact on the WTO Dispute Settlement Mechanism.According to the interpretation provisions of the Vienna Convention on the Law of Treaties,as an alternative dispute settlement method,the arbitration under Article 25 of DSU has the legal eff ect of substituting the appellate review procedure,which provides a legal basis for the normalized operation of WTO Appellate Arbitration.WTO Appellate Arbitration meets the institutional needs of the WTO Dispute Settlement Mechanism to prevent the risk of failing again and pursue a higher level of development,which is of positive signifi cance for the reform of the WTO Dispute Settlement Mechanism,thus the normalized operation of WTO Appellate Arbitration is reasonable.In the process of promoting the normalized operation of WTO Appellate Arbitration in the future,it is necessary to clarify the parallel procedural and substantive coordination relationship between the Appellate Arbitration and the Appellate Review Procedure,and properly address a number of issues that need to be considered for the normalized operation of WTO Appellate Arbitration,which includes the employment of arbitrators and arbitration secretaries,the fi nancing and allocation of funds,the formulation of model procedural rules,and the strict guarantee of the consistency of awards.
