论高危险性体育赛事活动行政许可的制度优化

摘　　要：现有法律规范并没有“高危险性体育赛事活动”的定义条款。鉴于立法语言的技术性模糊,可以从“高危险性”“体育赛事活动”,以及基于二者范畴之下的“高危险性体育赛事活动”三个层面分析高危险性体育赛事活动的属性。基于许可制度的预设功能,从《中华人民共和国行政许可法》的规范体例出发,发现高危险性体育赛事活动行政许可制度在许可设定、许可条件、许可程序、许可监管方面的规定较为粗疏。为实现发展体育运动和规范体育市场的立法目的,有必要进一步完善行政许可设定规范,统一行政许可条件,规范行政许可实施程序,优化高危险性体育赛事活动分类监管和缓冲机制。Existing legal norms do not define the term"high-risk sports events activities."Given the technical vagueness of legislative language,the attributes of high-risk sports events activities can be analyzed from three levels:"high-risk,""sports events activities,"and"high-risk sports events activities."Based on the preset function of the licensing system,and starting from the system of the Administrative Licensing Law of the People's Republic of China,the administrative licensing system for high-risk sports events activities is found to be relatively vague in terms of license setting,license conditions,license procedures,and license supervision.In order to achieve the legislative goal of developing sports and regulating the sports market,it is necessary to further improve the regulatory framework for administrative license setting,unify administrative license conditions,standardize administrative license implementation procedures,and optimize the classification supervision and buffer mechanism for high-risk sports events activities.
