摘 要:在承认与执行外国民商事判决时,被请求国法院对原审法院管辖权的审查是一个必不可少的步骤。在学理上,关于间接管辖权的审查标准有派生说和非派生说2种观点。各国立法和国际条约中对该制度的立法模式主要划分为指引式、列举式、混合式3种模式。2019年《海牙判决公约》统一了世界各国有关间接管辖权的规则,我国的司法实践和2023年修正的《民事诉讼法》也逐步确立了间接管辖权制度。但是,我国仍需要优化专属管辖的适用范围、进一步细化“适当联系”原则的适用标准,以确保间接管辖权制度能够得到有效实施。The review on the jurisdiction of the original cotrt by the cotrts of the requested comntry is anessential step in the recognition and enforcement of foreign civil and commercial judgments.Theoretically.there are two different views on the examination criteria for indirect jurisdiction.namely the derivative andnon-derivative theory.The legislative models for this system in varions cotntries'legislation and internationaltreaties are mainly divided into directive.enumerative.or hybrid models.The Hague Judgments Convention of2019 has unified the rules of indirect jurisdiction in various countries around the world.and China's judicialpractice and the Civil Procedtre Law revised in 2023 have gradually established the system thereof.However.in order to enstre the effective implementation of indirect jurisdiction.it is still necessary in China to optimizethe scope of exclusive jurisdiction and fiurther refine the application standards of the"appropriate connection"principle.
