摘　　要：随着我国老龄化格局加速形成,数字技术的发展导致数字技术代际撕裂的现象日益严重,老年弱势群体被数字壁垒隔离在外,出现了“银发数字鸿沟”之殇。在此背景下,保障老年人数字化生活权益的呼声持续高涨,催生了老年人数字化生活权这一新兴权利。老年人数字化生活权是互联网接入权的理论迭代,兼具生存权和发展权的双重属性,旨在维护老年人在数字社会美好生活的尊严,是“以人民为中心”这一中国人权发展和保障逻辑在数字时代的体现。当前,数字鸿沟、数字歧视等问题日益严重,为实现老年人数字化生活权,需要通过明确老年人数字化生活权的可诉性、加强检察保护等法治保障措施,在多元主体协作支持下以期保障老年人数字化生活权,实现数字社会的包容性增长。The development of digital teclnology is accompanied by the accelerated formation of China's agingpattern、and the phenomenon of intergenerational tearing of digital technology has become increasinglyseriots.with the elderly vulnerable groups being isolated by digital barriers.which catalyzes the death of the"silver-haired digital div ide".Against this backdrop.the call for safeguarding the rights and interests of theelderly in their digital lives continues to rise.giving rise to the emerging right of the elderly to a digital life.The right to digital life of the elderly is a theoretical iteration of the right to intermnet access.with the dualattributes of the right to subsistence and the right to development.and aims to safegnard the dignity of theelderly to live a good life in the digital society、which is the embodiment of the logic of"people-centeredness"as the basis for China's human rights development and protection in the digital era.At present.the digitaldivide.digital discrimination and other issues are becoming increasingly prominent.and in order to realize theright of older persons to live digitally.it is necessary to clarify the justiciability of the right of older persons tolive digitally、strengthen prosecatorial protection and other nule of law safegnards、in order to safegnard theright of older persons to live digitally with the collaborative support of a multitude of actors and to realize theinclusive growth of the digital society.
