粮食产销区横向利益补偿的逻辑展开与制度进路

摘　　要：实现粮食产销区的利益平衡是保障国家粮食安全和促进区域协调发展的内在要求。区域产权的存在使得区域形成独立利益,但分区制管理导致粮食产销区间的利益失衡问题突出,需由作为受益者的主销区对主产区予以公平补偿。权利是主体主张利益诉求的法治手段,在区域强制分工下主产区负有特别牺牲与主销区获利之间存在因果关系,故应基于利益平衡之原则,赋予主产区请求主销区给予利益补偿的牺牲补偿请求权。在此基础上,需完善软硬法并举的制度规范,优化纵横结合的府际关系,并建立激励约束、权利救济方面的配套保障机制,进而推动应有权利向法定权利、现实权利的转化,夯实粮食产销区横向利益补偿的制度保障。Achieving the balance of interests between major grain producing and marketing areas is an inherent requirement for ensuring national food security and promoting coordinated regional development.The existence of regional property rights makes the regions form independent interests,but the zoning management leads to the imbalance of interests between the main grain producing areas and marketing areas,so it is necessary for the main grain marketing areas as beneficiaries to make fair compensation to the main grain producing areas.Right is the legal means for the subject to claim interests.Under the regional forced division of labor,there is a causal relationship between special sacrifice in the major grain producing areas and profit in the main grain marketing areas,so the main grain producing areas should be given the right to claim sacrifice compensation based on the principle of interest balance.On this basis,it is also necessary to improve the normative system combining soft law and hard law,optimize the inter-governmental relationship in both vertical and horizontal dimensions,and establish a supporting guarantee mechanism in terms of incentive and constraint and right relief.Through these efforts,we can promote the transformation of due rights into legal rights and practical rights,and consolidate the institutional guarantees for horizontal benefit compensation.
