摘　　要：制定金融法是中国金融法治建设的重大理论和现实问题。从历史与现实之维来看,制定金融法是传承延续金融法治历史文化传统、有效回应当前金融领域突出问题的必然要求。从改革与法治之维来看,协同推进金融体制改革与金融法治建设是做好金融工作的基本经验,制定金融法是全面深化金融体制改革、强化金融法治建设的必然要求。从国内与国际之维来看,制定金融法是防范化解金融风险、维护国家金融安全、推动金融高质量发展、推动金融高水平开放、加快建设金融强国的必然要求。应当尽快明确制定金融法的总体思路,精准把握金融法的立法定位,科学选择金融法的立法模式,系统构建金融法的制度体系。The formulation of financial law is an important theoretical and practical issue in the construction of financial rule of law in China.From the perspective of history and reality,the formulation of financial law is an inevitable requirement for inheriting the historical and cultural tradition of financial rule of law and effectively responding to prominent problems in the current financial field.From the perspective of reform and rule of law,promoting financial system reform and financial rule of law construction in coordination is the basic experience of financial work,and formulating financial law is the inevitable requirement of comprehensively deepening financial system reform and strengthening financial rule of law construction.From the domestic and international perspective,the formulation of financial law is an inevitable requirement for preventing and defusing financial risks,safeguarding national financial security,promoting high-quality financial development,promoting high-level financial opening,and accelerating the construction of a financial power.We should clearly formulate the general idea of the financial law as soon as possible,accurately grasp the legislative positioning of the financial law,scientifically choose the legislative model of the financial law,and systematically build the institutional system of the financial law.
