摘　　要：知识产权保护与开放式创新之间的博弈衍生了知识产权档案保护与利用兼得这一新的议题。如何从数字经济带来的知识产权封闭危机、知识垄断带来的知识产权治理失灵中脱困,寻求知识溢出带来的知识产权协同创新之路,关键在于筛选知识产权档案利用的主体、打造流动式知识产权档案蓄水池、搭建交互式知识产权档案社区,最终实现灵活权变的战略权衡新模式。The game between intellectual property protection and open innovation has given rise to a new issue of safeguarding and utilizing intellectual property archives.The key to surviving the intellectual property closing crisis brought by digital economy and governance failure resulting from knowledge monopoly and exploring the path towards collaborative innovation of intellectual property brought by knowledge overflows lies in carefully filtering the users of intellectual property archives,establishing a dynamic reservoir of it and fostering an interactive community,ultimately forming a new mode of strategic balance with flexible contingency.
