摘 要:大运河流域协同治理的规范体系是区域立法与流域立法的有机结合,有助于实现流域保护治理规范化、法治化,而且可以拓展流域协同治理实践能力。然而从现实层面来看,大运河流域协同治理的法治体系存在缺少专门立法、立法的规范内容不明确、立法体系缺少激活机制等诸多问题,需要在制度构架、规范内容等多个领域发力。应当通过维护大运河流域协同治理的法制统一、采取综合立法路径、完善大运河流域协同治理的体制机制等措施,促进大运河流域协同治理的进一步法治化。The normative system of the collaborative governance of the Grand Canal basin is an organic combination of regional legislation and watershed legislation,which is conducive to the standardization and legalization of watershed protection and governance,and can expand the practical ability of the collaborative governance of the basin.However,from a practical point of view,the legal system of the Grand Canal basin collaborative governance faces many problems,such as the lack of specialized legislation,unclear normativecontent of legislation,and absence of activation mechanism in the legislative system.It is necessary to make efforts in many fields such as institutional framework and normative content.Measures should be taken to promote further legalization of collaborative governance of the Grand Canal basin through maintaining the legal unity of the collaborative governance of the Grand Canal basin,adopting a comprehensive legislative path and improving the system and mechanism of the collaborative governance of the Grand Canal basin.
